Mary Roy v. State Of Kerala - Synopsis
Mansi Salaria 5 Sep 2021
Mary Roy was a widow harassed and humiliated by her brothers as they want her to evacuate from her father's property. They even hired men to use physical force against her because according to Travancore Succession Act of 1916 the property is only for them and she was residing illegally. This law didn't recognize coparcenary rights of descendants whereas only recognized the acquisition of property through inheritance. Section 24 of this law says that mother who would be a widow would only get life interest in property and daughters who had already given Stridhan would not be able to acquire the property thereafter. Mary made the decision to fight the case against her brother to get equal rights in succession
