The Supreme Court in a Constitutional Bench had held that, regarding reservation for in-service candidates for Post Graduation Medical Course, no power has been granted to the Medical Council of India in any particular State. Justice Arun Mishra, Justice Indira Banerjee, Justice Vineet Saran, Justice MR Shah and Justice Aniruddha Bose were hearing a case Tamil Nadu Medical Officers Association Vs. Union of India [Writ Petition (Civil) No. 196 of 2018], and of the view that, the authority of the Indian Medical Council Act is alluded to in Entry66, List1, which is a limited source of power to lay down standards. The Court had held that, the regulations which are provided for in-service candidates in PG medical courses in the Medical Council of India are ultra vires of the Medical Council Act. However, The Court had stated that the decision will apply only prospectively and will not affect any admissions that had already been made. The Court also held that, rules and regulations for reservation of in-service doctors in PG medical course can be implemented by the State.
