Arnab Ranjan Goswami v. Union of India & ors. [Writ Petition (Crl) No. 130 of 2020] - Synopsis
Team SoOLEGAL 30 Dec 2020
The Supreme Court noted in a writ petition seeking the quashes of the FIRs submitted by the Republic TV Chief Editor Arnab Goswami that allowing the journalist, confronted with successive FIRs and grievances of the same grounds, to send several complaints and to request redresses from multiple states and their jurisdictions has a stifling impact on his rights. Justice DY Chandrachud and Justice MR Shah affirmed that the judgments hold that the journalist's freedom, in compliance with Article 19(1)(a), should not go further than the citizen's right to communicate and write, but it should not be ignored by the society that one cannot live without the other, and free people can't exist where the press is handcuffed to stick to one position. The court thus dismissed the prayer of Arnab Goswami to quash the FIR. It has also declined for transferring the probe to CBI, saying that the convicted party has no choice as to how the investigation can be handled, or as to the investigative body.
