PIL in Supreme Court against the withdrawal of Rs 500 and Rs 1000 Notes

After PM Modi’s surprise announcement regarding his decision to ban Five hundred and thousand rupee notes a couple of developments have taken place in the Supreme Court and Bombay High court.

A lawyer has filed a writ petition before the Honorable Supreme Court and a couple of lawyers in Bombay High Court mentioned the matter before Justice MS Karnik (single vacation bench) to take the suo-motu cognizance of central government’s decision because it has cause inconvenience to the general public at large.

In the Supreme Court of India Advocate Sangam Lal Pandey petition will be mentioned today, who wanted to writ of the certiorari quashing such “illegal and Arbitrary announcement” plus a writ of the mandamus “commanding centre” to provide enough time to the public to meet their necessary requirements. Advocate Pandey’s petition however requisites the announcement as “Tughlaki Farman”- term got popular after medieval period Indian ruler Mohammed Bin Tuglaq, basically his decision of change the currency and changing the capital from Delhi boomeranged that time.

Whereas Bombay High Court Lawyers Jabbar Shaikh and Jamshed Mistry argue that prior November 8 late night announcement, a notification came on November 2 also. This notification says that new 100 rupees notes will be introduced within 15 days as pilot project and that will cover 10 percent of all the ATMs. They have pointed out that within 6 days how come banks are so prepared for such a drastic change.
The Honorable Supreme Court will hear the petition today, while Bombay High Court directed advocates to approach regular bench once the court reopens after the Diwali vacations and starts working on a regular basis. Therefore a writ petition will be filed and mentioned on 15 November 2016.
