1- In a case where we dont have a bounced cheque or the limitation of filling 138 case has been crossed in that case also we can approach the Hon'ble Court and file RECOVERY SUIT. 

 

Even though RECOVERY SUIT is a civil case, at the time of execution, we can get the orders of property attachment against the defendant. It means that if the other party is unable to pay the  dues/fees/salary/recovery amount etc, the court will attach his property and further the attached property can also be auctioned to recover the amount from the defendant. Thus, in any case, the amount will be recovered. 

 

2- The second option is we can file a criminal complaint under section 420 IPC in police station. If the IO does not accepts the complaint and denies to register FIR, then we can get the FIR registered through Court also and then the trial will be initiated before Hon'ble Court. 

 

PROOF'S WE NEED:

 

1- Any cheque given by the accused/defendant or

2- Any signed agreement or

3- Any self-written statement or

4- Chats over whatsapp/ messages which proves the liability.

5- Phone call recordings

6- Conversation via mails/ facebook/ any social media site.
