How to Claim Car Insurance and file the Claim with the Insurance Company


Overview: Getting your insurance claim from the car insurer is easier said than done. It is often the case that the insurer will find ways and means to not honour the payment and instead find problems or discrepancies with the claim as filed by you. It is advisable to always read the policy terms and conditions and understand the claim procedure properly before buying insurance. It is a well known fact that consumer courts are flooded with cases against insurance companies arising out of failure of the insurer to honour the claim on one pretext or the other. 

Purpose: The purpose of this article is to provide an overview of filing a claim for car insurance.

Areas of Application of Law: The article is general in nature and does not pertain to any law as such, however, in case consumer case is filed, the Consumer Protection Act, 1986 will apply to those proceedings.

Process:

 

STEP 1: Inform the company. 

The insurance company must be informed within 24 hours of the accident/ incident.

The call can be made to the helpline number of the company. In case you yourself are unable to make this call have someone else do it for you as failure to give timely information will lead to difficulty in getting your claim processed and honored.

 

STEP 2: Keeping the information handy.

The helpline of the insurer company will ask for the information which will include- date and time of the accident, policy number, make and model of your car, vehicle number, brief description of the accident, extent of loss, garage you will be visiting and the location of the loss, your particulars etc.

 

STEP 3: FIR

It is advisable to file a FIR so as to indicate the veracity of your insurance claim. The insurance company may also insist on this. Please note that in case FIR is filed with delay, there may be problems in recovering the money later.

 

It is advisable to take your car to the network garage of your insurance company. Any repair work should not be done before the vehicle has been inspected by the insurance inspector.  A claim form along with copy of the driving license is to be left at the garage. Repair bills will also have to be submitted to the insurance company.

 

Some of the documents required for submitting the claim are:

 

Policy document, copy of registration book, copy of the license of driver of the car at the time of the accident, Police panchanama or FIR, repair estimates and bills (in case of accidents). These have to be sent ideally within 7 days to the company on its given address.

 

Original registration book, with an endorsement of the theft from the concerned RTO along with previous insurance details, sets of keys, service booklet and warranty card along with acknowledged copy of letter address to RTO intimating theft and making vehicle ‘non-use’ are required.

 

In a claim for personal accident, doctors reports, prescriptions, FIR etc. will be required to be submitted.

Punishment/Expected Relief: the insurance claim being processed and money to be received from the insurance company
