UP Family Court Orders Wife to Pay Rs 1,000 Monthly Maintenance Allowance to Husband

A petition was filed in Uttar Pradesh Family Court by a husband asking for maintenance from his wife who is government pensioner. The husband and the wife both are living separately for many years and in the year 2013, the husband had filed a petition asking for maintenance under Hindu Marriage Act, 1955.

On Wednesday 21, 2020, after hearing the petition of the husband, the Family Court was of the view that since, the wife is a retired government employee, so it will not be difficult for her to give maintenance allowance to her husband as she is getting Rs 12000/- per month as pension. The Court had held and directed the wife to pay a sum of Rs 1000/- per month to the husband as maintenance allowance from her pension amount.

As a matter of fact, generally a wife claims maintenance from her husband at the time of seeking divorce but in the current scenario Apex court has decided in favour of the husband which proves that the only aim of judiciary is to protect the intent of the statute irrespective of societal norms.
