Transgenders to have separate category in prisoners data: Centre tells Delhi HC

On Monday, 7th December, 2020, the Delhi High Court was informed by the Center that, all the states and union territories of India have received a communication to include report on transgender prisoners under a separate gender head in the statistics reports of the prisoners from 2020 onwards. Previously, in annual publication of NCRB’s Prison Statistics, India, there were only two categories i.e male and female.


Chief Justice D N Patel and Justice Prateek Jalan, were hearing a PIL in which Additional Solicitor General had asked for a direction to the National Crime Records Bureau to amend a new policy and to insert a separate head on gender which will give information about transgender prisoners.


The NCRB has now advised the State and the Union Territory authorities to order appropriate officials to plan for the collection of transgender data for the gender classification of prisoners when collecting data for Prison Statistics India-2020.


On 1st December, 2020, the division bench had asked NCRB for information regarding the decision which has been made for inclusion of transgender as separate head in the annual report of prison statistics. The plea also stated that the recognition of third gender can be seen in publications such as ‘Crimes in India’, ‘Accidental Deaths and Suicides in India’ etc.

The petition further argued that lack of adequate data on the number of transgender prisoners in India raises significant questions regarding handling of such prisoners. Introducing a new separate gender head for transgender prisoners is compulsory as it will help to keep track of every transgender prisoner.
