Timeframe for submission of Aadhaar details with welfare schemes extended to Dec 31

Deadline for submission of Aadhaar details, is mandatory for citizens in order to grab the benefits from any public welfare scheme. The Supreme Court is set to hear a batch of petitions concerning the Aadhaar-related issues in November. Due to the reason, the Government extends the primary time limit of Aadhaar submission from September 31 to December 31.

The Supreme Court agrees to conduct a trial on the State’s Aadhaar scheme under which a 12 digit number assigned to every citizen is mandatory to be associated with welfare programs, and every financial transactions carried out by any individual.

Last week, a rare SC bench of nine Judges headed by former Chief Justice of India J S Khehar, held the Right to Privacy as the Fundamental Right under the Article 21 of the Constitution. The petitioner challenged the Government’s decision of making biometric data-enabled Aadhaar identification mandatory for all citizens, terming it as the violation of People’s Right to Privacy.

Debate on Aadhaar link will be continued in November 2017. Earlier, the bench said that the hearing on a petition challenging the constitutional validity of Aadhaar identification, cannot be continued till the Judgment in privacy case is delivered. Now, the privacy has been declared as a Fundamental Right, the bench is set to discuss on whether the Government’s linking of Aadhaar details to tax returns, direct financial transactions to beneficiaries of welfare scheme and bank loans, infringes that Fundamental right.

The Government, in support of Aadhaar scheme, claims that Aadhaar is a secure form of digital identification for citizens which can be used for Government services while streamlining welfare benefit payments and reducing wastage. They submitted that Aadhaar database has already recorded biometrics of over 1 billions citizens and follows incomparable security measures to protect the privacy of registered citizens.

To counter the Aadhaar scheme, the petitioner stated it as a mean for Government to secure unqualified surveillance power over citizens.
