The Supreme Court Tweaks Rules Relating to Fast Track Appeals in Cases of Death Penalty

New Delhi: The Supreme Court has issued guidelines for the prompt hearing of criminal appeals involving cases attracting the death penalty, in consideration of the backdrop of delay in executing the four death row convicts in the Nirbhaya gang-rape case.


The apex court has set a six-month time-limit for hearing an appeal against death sentence cases from the date of verdict passed by the High Court. These appeals will be placed within six months before a three-judge court, regardless of whether or not all the paperwork and records related to the case have been filed.


The directions were given on February 12th 2020 by the apex court, by way of an administrative order. The order also laid down deadlines for obtaining high court records pertaining to the case and for parties to file additional documents as well.


The respective order of the apex court states that, “as soon as an appeal involving a death penalty is filed, a communication will be sent to the concerned high court by the Supreme Court registry calling for the original records of the case within sixty days. This includes translation of documents which are in vernacular language”.


Moreover, the order has specified that, once the Supreme Court has accepted the matter, parties will file additional documents within thirty days of the date on which the court's registry informs the parties of the same.


When paperwork or relevant documentation are not obtained or filed within the specified period of time, the case will be placed in chambers before the judge, so that correct orders can be issued.

These changes came in the backdrop of events in the 2012 Delhi gang-rape case, involving the hanging of the four convicts.
