Supreme Court talks tough on honour killings, says Centre must protect couples from such 'khap' actions

While hearing a writ-petition regarding the offence of honour killing, The Supreme Court (SC) today directed the Centre to keep couples safe from any violence from Khap Panchayat.

During the hearing, the lawyer representing Khap Panchayats told the Court that they never oppose inter-caste or inter-religious marriages. But the Panchayats are opposed to marriages between Sapindas (siblings’ marriages). He further said that Section 5(v) of the Hindu Marriage Act prohibits marriages between close cousins.

In response to counsel's statement, a three-judge SC bench, consisting of Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud made some interesting remarks during the hearing.

“Where two consenting adults agree to get married, no individual rights, group rights or collective rights shall interfere therein or harass the couple”, the SC bench said.

Further, the top court told the 'khaps' that they cannot become "self-appointed conscience keepers". The court also added that there are courts to deal with marriages that may be prohibited by law.

The next hearing on the matter is scheduled for February 16.
