Supreme Court rejects ex-judge Karnan’s bail plea

A vacation Bench of Justices D.Y. Chandrachud and S.K. Kaul said the court was bound by the order of the seven-judge Bench on the case

The Supreme Court on Wednesday refused to entertain former Calcutta High Court judge C.S. Karnan’s plea seeking interim bail and suspension of the six-month sentence awarded to him for contempt of court.

A vacation Bench of Justices D.Y. Chandrachud and S.K. Kaul said the court was bound by the order of the seven-judge Bench on the case and retired judge Karnan — arrested on Tuesday after being on the run for more than a month — should mention the matter before a Bench of the Chief Justice. Only the special bench could hear the plea, the judges said.

Appearing for Karnan, advocate Mathew J Nedumpara said this court had all the powers and should grant the interim bail till the reopening of the court. To this, the vacation Bench said it could not override the order of the seven-judge Bench.

Justice (retd.) Karnan, who was evading arrest since May 9, was arrested by the West Bengal police from Coimbatore on Tuesday.

“Justice [Retd.] Karnan will be brought to Kolkata on Wednesday. He will be taken to the Presidency Jail [in south Kolkata] after medical examination,” Additional Director General of West Bengal's Criminal Investigation Department Rajesh Kumar told The Hindu.

The Supreme Court issued the contempt of court notice against Justice Karnan in February for allegedly degrading the judicial institution.

The seven-judge Bench, led by Chief Justice of India J.S. Khehar, heard Attorney General Mukul Rohtagi, who said that Justice Karnan should face contempt proceedings for his “scurrilous” letters against sitting and retired High Court and Supreme Court judges.
