Supreme Court Refuses to Recall Order Dismissing the Plea on Plight of Migrants of Mahua Moitra

On Friday, 5th June, 2020, the Supreme Court of India declined to revoke the order passed on April 13th that rejected the Court's suo moto writ petition on a letter appeal submitted by TMC MP Mahua Moitra.

A bench comprising of Justice Ashok Bhushan, Justice S K Kaul and Justice M R Shah rejected Moitra's fresh interlocutory appeal in the suo moto case adopted by the Court on the issue of migrants.

"She is a respected Member of Parliament. If we allow this to happen, it will become a messy situation. We have Union and States assistance" Justice S K Kaul told senior lawyer Jaideep Gupta, who represents the MP from Krishnanagar, West Bengal.

The bench stated that there was no requirement to recall the order, as in the suo moto case the Court was already considering the questions.

"We see no reasonable cause to revoke the order because this Court has already discussed SMW (C) No. 6/2020 where all the problems are being addressed," the order said.

However, the bench allowed the Senior Advocate to make submissions on which he put forward some suggestions for streamlining the transport and registration of migrants. The Court reserved orders in the matter for June 9th after hearing the Centre, several states and a few interveners.

In the motion for recall, Moitra also tried to create an independent committee supervised by the court to examine the problem and propose necessary solutions, arguing that the government of the Union had "absolutely failed" to take charge of the situation.

The Court had taken suo moto notice, on April 3rd, of a letter written by her concerning the plight of stranded migrant workers. The letter has been turned into a writ petition, and Central Government has requested a survey. However, the Court dismissed the writ petition on April 13th, without stating any reason, by a one line order.
