Supreme Court Quashes Plea Seeking Probe Into Sahara-Birla Diaries

The Supreme Court on Wednesday dismissed Prashant Bhushan’s plea seeking a probe into the Sahara-Birla Diaries case stating that Bhushan had failed to provide enough proof to substantiate the charges.

"The process of law can be misused for ulterior goals if such documents are treated as legal evidence and probe is ordered,” the Supreme Court observed and added that the plea was “devoid of merit.”

Last week, Prashant Bhushan had filed an affidavit in court claiming new evidence in the Sahara-Birla Diaries case and has attached an I-T report which showed that kickbacks were routed through one individual to several politicians.

The Supreme Court had earlier asked Bhushan to submit additional evidence in the case to order a probe. The new detailed affidavit was based on the I-T raids which were conducted on the two corporate houses in 2013 and 2014. 

The Supreme Court’s decision also comes as a setback for Congress Vice President Rahul Gandhi, who had used the plea filed by Prashant Bhushan to attack Prime Minister Narendra Modi, claiming that he received kickbacks when he was the Chief Minister of Gujarat.

Rahul Gandhi had accused Prime Minister Narendra Modi of receiving money in crores from the Sahara and the Birla group. Rahul had demanded that an inquiry be launched into this.
