Supreme Court agrees to hear a petition to terminate Nitish’s membership of the MLC

The Supreme Court Today agreed to hear a plea attempting to disclose Bihar Chief Minister Nitish Kumar’s Membership of the State Legislative Council for allegedly concealing a pending criminal case against him wherein he was accused of killing a local Congress leader Sitaram Singh, and injuring four others ahead of Lok Sabha by-election to the Barh constituency in 1991.

A Supreme Court bench headed by Justice Dipak MIshra, Amitava Roy and A M Khanwilkar stated that it will examine the facts of the case after petitioner Advocate M L Sharma sought an urgent hearing of his plea. The bench stated that the matter will be heard once the listing is done.

The petitioner has also attempted to initiate a CBI investigation by directing CBI to register an FIR against Nitish Kumar, based on the gravity of the case.

Nitish Kumar’s newly formed cabinet is also facing criminal charges against its leaders. Almost, 21 out of 28 leaders have pending criminal cases against them, according to the affidavit submitted by these leaders to the Election Commission. Only 7 of them are free of any charges or pending cases.

The petitioner attempted to unveil Nitish Kumar’s membership as per the directions of Election Commission wherein stating it is obligatory for nominees to present any pending case in their affidavit annexed to nomination paper. He stated that the accused paid no heed to disclose pending cases against him in affidavits since 2004, except for 2012.

The other respondent (Election Commission) paid no attention to pending cases against Nitish Kumar and despite knowing facts about his intentions of concealing it, they did not revoke his membership of the MLC and Respondent Nitish Kumar still enjoys constitutional office till date, the petitioner stated to the court.
