Sunanda Pushkar Muder Case: Delhi High Court rejects Subramanian Swamy's plea

The Delhi High Court on Thursday dismissed a petition of senior BJP leader Subramanian Swamy seeking a probe into the death of Congress MP Shashi Tharoor's wife Sunanda Pushkar. The court said his PIL was left with a distinct impression that this was perhaps a textbook example of "political interest litigation" being dressed up as a public interest litigation. Mr. Swamy appeared to have concealed data or information, which he should have disclosed at the first instance.

A bench of Justices S. Muralidhar and I. S. Mehta said the petition by Swamy cannot be entertained as a PIL. The bench also said that from what was placed before the court, it was unable to be persuaded that the probe, being carried out by the SIT, is botched up or under the influence of any party.

Swamy and Bhandari had moved the High Court in July seeking a proper and time-bound probe in the case, which they had said ​​"is an extreme example of the slow-motion of the criminal justice process and the extent to which it can be subverted by the rich and influential. It unfolds the apparent apathy on the part of all those concerned with the administration of criminal justice".
