Student loses IIT Bombay seat due to ‘wrong’ click, moves Supreme Court

Supreme Court was hearing a petition which was filed by an 18 year old student, in which he had asked for a direction to IIT Bombay to admit him, after the said institution had informed the student about the non-availability of seats. The 18 year old student, Siddhant Batra, while filling up the online form for IIT Bombay, had clicked on a wrong link and that led to loss of his seat. According to the institution, the student can again apply for JEE (Advanced) in next year.

According to the plea, the petitioner had secured a rank of 270 in the said exam and had also secured an admission. The plea also stated that, the petitioner had clicked a wrong link which was meant to withdraw the seat and as a result his seat was withdrawn. It added that the petitioner had never intended to revoke his admission.  However, the IIT said that the withdrawal option was only a two-step procedure. It said that candidates who wish to withdraw before the final round could do so and that the 'seat acceptance charge' will be refunded. The institution had also told that, after the applicant has withdrawn, his or her seat will be cancelled.

The Bombay High Court had dismissed the petition by stating that the institution had already considered its representation and passed its order. Being aggrieved, the petitioner has further appealed to the Supreme Court.

In this particular petition, the petitioner has asked for a direction to IIT Bombay to consider his mistake and also to consider his case on humanitarian grounds and create an extra seat for him and treat this case as an exception. As per the petition, while completing the online admission process, the petitioner came to a page with the 'freeze' option, which he thought meant confirming the seat and completing the admissions process.
