Shahjahanpur Court Refuses to Grant Bail to Chinmayanand & Law Student


A Sessions Court at Shahjahanpur on Monday, refused to grant bail either to BJP Leader Swami Chinmayanand in the alleged Sexual harassment and Rape case or to the Law Student who had filed the said case against Chinmayanand but is herself in custody over the allegations of extortion by Chinmayanand.

 

A bail plea filed earlier by Chinmayanand before the court of Judicial Magistrate at Shahjahanpur was dismissed last week with directions to approach the Sessions Court. He was arrested on September 20 by a Special Investigation Team (SIT) on the allegations of Sexual harassment and Rape levelled by the female law student. The victim had provided the SIT with sufficient material and one pen drive including video proofs after which Chinmayanand was arrested from his Ashram and was sent to 14 days judicial custody by the Court.

 

The law student had applied for grant of pre-arrest bail after three men known to her were arrested by the SIT on the allegations of extortion and demand of money levelled by BJP Leader Swami Chinmayanand. The bail plea filed by the law student was also refused by the Allahabad High Court stating that the bench was constituted specifically for monitoring of investigation by the SIT and till date they were satisfied with the investigation carried out by SIT. The Bench had further advised the victim to move an appropriate application for bail before the concerned court.

 

As per High Court’s direction, the law student had filed a pre-arrest bail application before the Sessions Court at Shahjahanpur and the application was listed to be heard on September 26, but, the girl was arrested by SIT from her home on September 25 thereby leaving the pending bail application as infructuous. The victim was also sent to 14 days Judicial Custody by the Court.

 

SIT was compelled to arrest the girl in extortion case after it discovered that the girl and three men arrested earlier had exchanged phone calls with each other for approximately 4,300 times around the time when alleged extortion calls were made to Chinmayanand demanding a sum of Rs. 5 crore and threatening him of releasing his objectionable videos in social media.

 

Therefore, both Swami Chinmayanand and the law student had applied for grant of regular bail before the Court of Sri Ram Babu Sharma, Ld. District & Sessions Judge, Shahjahanpur which heard the matter on Monday and refused to grant regular bail to both at this stage of investigation.

Disgraceful! the victim should have been granted bail at least. The offence of which she is charged with is not as serious as committed by Swami Chinmayanand.
