Set up Committee to Examine, Recommend Welfare Measures to Clerks of Lawyers, says Delhi HC

A two-judge bench of the Delhi HC, consisting of Chief Justice Rajendra Menon and Justice V K Rao, on Thursday decided to constitute a committee to “examine and recommend” several welfare measures like provident fund, pensions and group insurance policies to lawyers’ clerks.

The Bench said that the panel would comprise the Registrar General of the High Court, two senior advocates, the president and secretary of the Delhi High Court Bar Association (DHCBA) and a nominee from the clerks’ association.

The High Court issued the direction considering the “important” role played by the clerks in the legal system.

The Bench also said that the committee after examining the issues shall submit a report before the court.

In the petition, DHCBCA has contended that its members have been deprived of their fundamental rights, including the right to medical benefits to a workman, as provided to legal practitioners under The Advocates’ Welfare Fund Act, 2001.

The petition also cited that several states like Kerala, Tamil Nadu, Andhra Pradesh, Himachal Pradesh and Odisha have already passed a law to promote the welfare of clerks – who have to rely on charity and donation of the advocates employing them.

Thus, DHCBCA urged the court to direct the authorities to implement and enforce various schemes, to effectively secure and promote the clerks’ fundamental rights to social security and welfare measures.
