Self proclaimed godman Asaram, who contended easy contraction of Covid-19 was denied interim bail by the Gujarat High Court

The high court of Gujarat denied temporary bail to self-proclaimed godman Asaram, who stated he would contract Covid-19 relatively easily if he were to stay behind bars. He had moved the Court claiming that he would be more vulnerable to the coronavirus which is currently prevalent in India and across the globe, due to his age and various other ailments.

Asaram, who is currently 84 years old, is locked in the Central Jail of Jodhpur, serving life term as levied by a Jodhpur court in connection with a rape case. He is also facing trial before a court in Gandhinagar for another case involving sexual assault.

The counsel appearing for Asaram relied on the Supreme Court’s contention which stated that in order to tackle the Covid-19 pandemic, prisons must be decongested and fit convicts must be released on temporary bail. The counsel, based on this reliance told the court that Asaram would be a fit candidate to be released on temporary bail.

The counsel appearing for the state objected to the bail plea, highlighting the severity of the alleged crimes and the denial of earlier routine bail applications brought by him before the Supreme Court.

The state contended, "Considering the seriousness of the alleged offences, the earlier applications for regular bail of the applicant have not been granted by this Court and by the Apex Court, and therefore, the present application for temporary bail should not be entertained".

Taking notice of the same, the bail was refused by the High Court. Justice Bela M. Trivedi who was judging the matter also highlighted that Asaram did not qualify for the category of undertrial offenders, who are recommended to be released on interim bail by the state's High Powered Committee, in compliance with the Supreme Court's order.
