Sedition Case: Activist Shehla Rashid granted interim protection from arrest by Delhi Court.

In the recent development regarding the sedition case lodged against the student politician and Kashmir activist Shehla Rashid, a Delhi Court has granted her interim protection from arrest in the recently lodged sedition case against her.

The Court of Addl. Sessions Judge Pawan Kumar Jain of the New Delhi District (Patiala House Courts) has granted interim relief from arrest to accused Shehla Rashid in the bail application filed by her lawyer.

Senior Advocate Satish Tamta appearing on behalf of the accused submitted before the Court that the accused had shared some information on her Twitter account on 17th August in relation to the present situation in Jammu & Kashmir.

On the basis of her comments, one advocate filed a written complaint with the Special Cell of Delhi Police and on its basis, the police had registered an FIR under sections 124A/153A/153/504/505 IPC against the Kashmiri Activist.

The Senior Counsel also submitted that the accused was willing to join the investigation and cooperate with the authorities.

On the contrary, the Ld. Additional Public Prosecutor mentioned before the Court that till date, police did not issue any notice to the accused and further submitted that the police needed a substantial time of at least 6 weeks to investigate the complaint.

Considering all these facts, the Ld. Addl. Sessions Judge was of the view that the matter required investigation in detail and therefore, placed the bail application pending for further proceedings on November 05.

However, the Court clarified that the accused shall not be arrested by the Investigating officer but shall join the investigation upon the instructions of the Investigation Officer as and when required.
