Sealed envelope reply: Delhi HC asks Government to clarify why Army men need to delete social media apps

On Tuesday, July 14, Central Government was directed by the Delhi High Court to file a response in a sealed envelope mentioning various policies under which an Indian Army Personnel is required to delete all social media accounts.

A petition was filed by Lt. Col. P.K. Choudhury challenging the notification of Indian Army on deleting various social media accounts including Twitter, Tiktok, Facebook, Instagram etc. The petition further stated that it is very much impossible for an Indian Army to delete all his social networking accounts, because social networking accounts are the only way in which an Indian Army can contact to his family or friends especially those Indian Armies who are living in remote places.

The petition also submitted that, on the one hand, the government is preparing to sensitize and educate its officers to ensure the safe and efficient use of social media and, on the other hand, it is telling its officers to remove their social media accounts.

Justice Rajiv Sahai Endlaw and Justice Asha Menon had refused to entertain the plea for interim relief. According to the Court this particular matter must be dealt carefully as this case is directly related to safety and security of the country. Hence for this reason interim relief cannot be granted.

The petition also stated that if the social networking accounts are deleted then all the details of friends, contacts etc will also be deleted and it is not recoverable. However the Court rejected this statement and concluded that the social networking accounts once deleted can also be created once again. The petitioner is a part of Indian Army and he must follow the rules and regulation of the organisation.
