SC/ST community from other states cannot claim quota benefits in govt jobs, says SC

The Supreme Court today held that a person belonging to the Scheduled Caste and Scheduled Tribe community cannot claim reservation benefits in government jobs in other states where their caste is not notified.

Headed by Justice Ranjan Gogoi, a five-judge constitution bench comprising Justices N V Ramana, R Banumathi, Mohan M Shantanagoudar and Justice S A Nazeer, held that:

A person notified as Scheduled Caste in state A cannot claim the same status in another state on the basis that he is declared as Scheduled Caste in state A.”

The judgement came on a batch of petitions that had raised the issue whether SC/ST members in one state can seek quota benefits for government jobs in another state where his/her caste is not notified as SC/ST.

The SC bench also held that the central reservation policy regarding SC/ST would be applicable in Delhi. However, the ruling was not unanimous, with Justice Banumathi dissenting.
