SC reprimands Lawyer for circulating ‘unwarranted & baseless’ insinuations against CJI on social media platform

The Supreme Court on Wednesday rebuked a lawyer for circulating "unwanted and baseless insinuations" on WhatsApp against CJI Dipak Misra for refusing to take note of the lawyer’s request for early hearing of a petition.

When the lawyer stood up again on Wednesday and requested for an early hearing of the petition, the top court bench of Justices Misra, AM Khanwilkar and DY Chandrachud took strong exception to the lawyer’s conduct.

“CJI takes split second decisions about petitions which require an urgent hearing while entertaining 50 such requests from lawyers during the first half an hour every day. If an urgent hearing request is denied, should a lawyer resort to such baseless insinuations against the CJI on social media platforms?”, Justice Chandrachud asked the complainant lawyer.

Justice Chandrachud also added that, “When you make such baseless allegations against the CJI for not acceding to your request for urgent hearing, it only damages the institution of the judiciary. The judges have no platform to defend themselves. We have no problem when our judgments get discussed in any forum. But judges are defenseless against circulation of such canard on social media platforms. Those sending or circulating messages on social media should exercise some restraint and responsibility”.

Further, Justice Khanwilkar said that, “In judiciary, the nature of the job is that some get relief while others don’t. And in case one does not get relief and targets the judges, then it will be very unfortunate for the institution”.

The complainant lawyer also mentioned some remarks of the ex-Justice J Chelameswar before the SC bench. To this, Justice Chandrachud said, “We as judges have a tenure. After our retirement, if one walks up to us and seeks our view and then uses it to target judges, it does not augur well for the judiciary.”

CJI Dipak Misra once again declined the lawyer’s request for early hearing.
