SC refuses interim bail to Karti, ask him to approach Delhi HC

New Delhi: A Supreme Court bench led by Chief Justice Dipak Misra refused to grant anticipatory bail to Karti Chidambaram protecting him from possible arrest by the Enforcement Directorate (ED) in the INX media money laundering case and asked him to approach Delhi High Court for any interim relief.

The SC asked Delhi High Court Chief Justice Gita Mittal to assign Karti’s plea to an appropriate Bench for hearing on Friday, March 9.

The SC said, the HC would deal with the plea and provide interim relief according to law. The court witnessed heated exchanges where the Chief Justice took strong exception to Kapil Sibal, the Council for Karti, remark where he suggested that Court was taking dictation from Additional Solicitor General Tushar Mehta, who is representing the Enforcement Directorate in the case. Chief Justice said they are aware of their responsibility and they take Mr Sibal's remark as one which lowers the dignity of Judiciary. Mr Sibal apologised to the Court.

Mehta vehemently opposed submissions made by Karti’s council, that he should be allowed to withdraw the writ petition and approach the Delhi HC.

“Allowing the petitioner to withdraw and approach the High Court by Supreme Court will send a wrong signal to all those who are facing money laundering case. There will be 50 petitions next day. What message we will be sending to others,” Mehta said.

Karti had approached the top court seeking direction to declare that the Enforcement Directorate had no jurisdiction to conduct any investigation unrelated to the allegations in the FIR lodged by CBI on May 15, 2017.

He was arrested on February 28 in Chennai immediately after he returned from abroad. The ED had registered a case against him and others in May last year. It had registered an enforcement case investigation report (ECIR), against the accused named in a CBI complaint. These included Karti Chidambaram, INX Media and its directors, Peter and Indrani Mukerjea. Currently, he is in the custody of the CBI till Friday and apprehends that the ED might arrest him.

Sibal wanted one week’s interim protection for Karti from arrest by Enforcement Directorate during pendency of his plea in the high court, saying it was nothing but “political vendetta” and “witch-hunt”. But the top court did not pass any such order.
