SC Dismisses PIL seeking reduction of pendency of cases and appointment of judges

The three judge bench of the Supreme Court, headed by CJI Dipak Misra today dismissed a PIL which sought appropriate steps be taken to reduce pendency of cases and appointment of judges to the High Courts.

The PIL was filed by SC lawyer and BJP spokesperson Ashwini Kumar Upadhyay, who had demanded that the vacations of judges be cut short to reduce the pendency of cases. In the PIL, Upadhyay had also sought a direction to all courts, including SC to work six hours a day, and 225 days a year.

But, when the matter came up for hearing before the SC bench, Upadhyay said he has dropped the prayer.

When CJI Dipak Misra asked advocate Vikas Singh, who had appeared for Upadhyaya, “So you want judges to work 225 days a year?”, the advocate replied “No I am not pressing that prayer. Only the rest. All others are accepted recommendations”.

Following Singh’s response CJI said that in respect of his other prayers he has already written to the Chief Justices of all States to take necessary steps to reduce the case pendency.

He further told Singh that the appointment of judges is also taking place and a few concerns have been answered by the bench in the Madras Bar Association case.

The CJI then said that the bench appreciates Singh’s concern, but other prayers do not need any consideration.

The CJI had on June 25th written a letter to all High Court Chief Justices to implement a ‘Disposal Review Mechanism' to speed up the disposal of pending cases in the Indian judiciary system.
