SC declines urgent hearing on PIL seeking declaration of Kejriwal's protest as “unconstitutional”

The Supreme Court today declined the request for an urgent hearing on a petition seeking its direction to declare the sit-in protest of Delhi’s chief minister Arvind Kejriwal and his cabinet ministers inside the lieutenant governor’s office as “unconstitutional”.

A vacation bench of Justice SA Nazeer and Justice Indu Malhotra said the PIL would be heard once the court reopens after the summer vacation.

Lawyer Shashank Sudhi, representing the petitioner, urged the court for an urgent hearing of the plea, saying a constitutional crisis has been created following the “the unconstitutional and illegal” protest at the L-G’s office in Delhi.

Sudhi further said that the protest has made the administration paralysed, due to which the citizens are “left high and dry”.

Sudhi told the bench, that the Delhi High Court had heard the matters on the issue on Monday, and has now listed them for hearing on June 22 and that the city is suffering. The city is facing an “emergency situation” in the form of a severe water crisis, he said.

The plea which was filed by advocate Hari Nath Ram besides seeking the sit-in protest to be declared as unconstitutional, also demanded initiation of perjury proceedings against either the CM or the L-G office – on the ground that one of them is lying.

The High Court had yesterday raised questions on the sit-in led by Kejriwal at the L-G’s office and asked the AAP government who had authorised such a protest.
