Press Release: BCI to Protest against the Higher Education Commission of India Bill, 2019


The Bar Council of India on Wednesday, October 2 has released a notice stating that the Bar will protest against the “Higher Education Commission of India (Repeal of University Grants Commission) Bill, 2019” and Abrogation of powers of the Bar conferred by the Advocates Act, 1961.


The topmost regulating authority of the legal field in India has decided to strongly protest the move of Union Government to take away the functions of Bar Council of India (under the Advocates Act, 1961) and to handover the powers relating to the regulation of Legal Education to the proposed Higher Education Commission.


The notice mentions that the BCI has decided to hold a Joint Meeting at Delhi on October 12, 2019, of all the State Bar Councils in the premises of Bar Council of India. The Council has already sent representations to the Hon’ble Prime Minister, Union Home Minister and all other Union Ministers explaining the detailed reason for their opposition to the inclusion of Legal education in the said Bill.


The notice clearly states the BCI would be holding protest rallies in all the State Capitals as well as in Delhi and Gherao the Parliament during the winter session if the Bill is moved and Advocates Act is not excluded from the ambit of the Bill. More than one lakh lawyers are likely to participate in the said protest rally and Gherao in the month of November 2019.


The letter signed by BCI Chairman and Senior Advocate Manan Kumar Mishra along with BCI Co-Chairman and Advocate Ved Prakash Sharma, further signifies that last year also the move to introduce such Bill was proposed but with the intervention of Hon’ble Prime Minister and Union Home Minister, the proposal was dropped.


The Council in its letter to the Prime Minister and other Ministers has explained that it has a very sound Statutory Legal Education Committee, which is headed by a former Judge of Supreme Court of India and consists of two sitting Chief Justices of High Courts, several sitting and former Judges of different High Courts, three Vice-Chancellors of National Law Universities noted academicians and Secretary, Legal Department to take care of standard and regulation of Legal Education in Inda.


The notice further points out that the NLSIU, Bangalore was created by the Bar Council of India and it has a very high ranking, globally, among Law Universities. Only recently, the Bar Council of India has put a moratorium of three years against affiliation of a new law college or university in India.


The main reason for protest as contemplated by the Bar Council is that Legal Education cannot be allowed to be regulated by outsiders, social workers or teachers. The Council has raised the demand to spare the professional legal studies from the purview of “Higher Education Commission of India (Repeal of University Grants Commission) Bill, 2019”.


The notice lastly mentions that in its General Council Meeting, the Council has decided to protest by tooth and nail the constitution of any other body for regulation of Legal Education in the country.


The present press release and representations sent by the BCI regarding the offending provisions of the proposed draft is a result of the General Body Meeting and Resolution passed on September 28, 2019, by the Council.
