Physical hearings to begin in hybrid manner first, CJI tells advocates in meeting

On Monday, 1st February, 2021, during a meeting between Chief Justice SA Bobde and senior advocates of Supreme Court Advocates-on-Record Association’s (SCAORA), Chief Justice had told that, the process to resume physical hearing had begun and physical hearing will soon be introduced in a form of hybrid hearings. It was also informed by the Chief Justice that the physical hearing will only be based on normal listing and not on the consent of the Advocate-on-Record or advocates,

In the meeting except for Chief Justice SA Bobde, BCI Chairman Manan Kumar Misra, Solicitor General Tushar Mehta, Supreme Court Bar Association and Senior Advocate Vikas Singh were also present. Chief Justice had informed all the members who were present in the meeting that, physical hearing will soon be available in a hybrid manner, that is, both physical and virtual mode. Dr. Joseph Aristotle S, secretary of SCAORA had stated that, the physical hearing will only take place, after considering the advice of the medical board and also after taking into consideration the technology infrastructure and availability of Registry Staff.

Due to Covid-19 pandemic, Supreme Court was conducting proceedings in virtual mode only. According to an earlier notification, lawyers and litigants had been restricted to enter the premises of the Court. It was the introduction of the Covid-19 vaccine that increased the demand for the resumption of physical hearing. On Sunday, SCAORA wrote to the Chief Justice demanding the resumption of a physical hearing with existing virtual courts in a hybrid fashion, because many advocates, mainly junior advocates, are faced with financial difficulties. Also, many litigants are similarly faced with challenges, because there are many matters which are not yet listed.
