Non-bailable warrants issued against absentee firm owners in tax case: Madras High Court

The Madras high court granted non-bailable warrants against the owners of two Chennai-based companies who imported earthmovers from China in 2008 but did not pay the vehicles' entry tax.

On Wednesday, i.e., 01.09.2021, Justice S M Subramaniam issued an interim order in response to Grandhe Construction Private Limited as well as Sri Murugan Earth Movers' pleas for entry tax exemption for imported vehicles.

When the cases, which were filed in 2008, were called for a final hearing on August 17, the petitioner's counsel sought numerous adjournments to seek instructions from the petitioners. They claimed that because the petitioners' issues were settled by the Supreme Court in 2018, they needed to get instructions from them on how to pay the entry tax.

The court ultimately took the cases for hearing on August 31 after granted many opportunities.

The petitioners' counsel then informed the court that they had notified the petitioners about the writ petitions' hearing before the court, but that the petitioners had failed to respond. Counsel informed the court that the petitioners went so far as to claim that they were unable to pay the entry tax.

“In view of the petitioners' stand and considering the submissions made by counsel for the petitioners, this court is inclined to issue non-bailable warrant to the petitioners, returnable on September 6,” Justice Subramaniam said after hearing the submissions.

The court further ordered the high court's registry to communicate the order to the Chennai commissioner of police, who will then carry it out with the help of the jurisdictional police.
