National Herald Case: Delhi HC allows I-T dept to probe, big blow to  Gandhis

In a major setback to the Sonia & Rahul Gandhi , the Delhi High court on Friday declined to stay the investigation order into the Young Indian Private Limited (YIPL) in the National Herald case – a company in which the Gandhis are directors.

A bench of Justices S Muralidhar and Chander Shekhar allowed the company to approach the Income Tax assessing officer, after which the firm withdrew its petition. 

The Delhi High court then dismissed the plea as it was withdrawn. Young Indian Private Limited had approached the high court seeking a direction to stay the IT proceedings and quashing of notices against it with regard to the National Herald misappropriation of assets case. The company was issued notices regarding the assessment year 2011-12. The Delhi High Court's order is a big blow for the Gandhi family who may have found themselves in the midst of a major scam.

Previously, the Patiala High court bench has ordered the YIPL to submit its tax documents, adding that it cannot be arrogant in such sensitive matters.

The National Herald case has gained considerable footage over the years, and it again gained weight after the Patiala High court had allowed an investigation in the case, but it was later challenged in the Delhi High court.

The issue came to the fore after BJP leader Subramanian Swamy accused the Gandhis and others of cheating and misappropriation of funds. He alleged that the Gandhis, using their company YIPL, managed to claim Rs 90 crore by paying just Rs 50 lakh.

The other prominent names in the case are Motilal Vora, Oscar Fernandes, Suman Dubey, and Sam Pitroda, however, all of them have rubbished the allegations levelled against them.
