Lawyer arrested for allegedly harassing woman journalist inside SC premises

For the second time in less than a month, another instance of sexual harassment has surfaced in the Supreme Court, wherein a lawyer has been arrested for allegedly harassing a woman journalist inside the court premises.

In a report published in Bar&Bench, Pranay Kumar, who is in his 30s, was arrested by the Delhi Police on September 3 after an FIR was registered against him under Section 354 of the Indian Penal Code (IPC).

The complainant journalist, while talking to Bar&Bench, said that the accused lawyer allegedly molested her not once, but twice – inside the top court’s premises.

The first instance happened on July 12 in the corridor of the apex court, and right outside the CJI’s Court. And, the second incident occurred on July 27 inside a Court no. 3 during an ongoing session.

It was after the second incident that made the complainant approach the Assistant Commissioner of Police stationed at apex court, the office of the Registrar of Security and the Sexual harassment Cell at the Supreme Court in order to initiate action against the accused.

The complainant later filed a written complaint against the accused on July27 at the Tilak Marg Police Station, and an FIR was registered against Kumar.

The Bar & Bench report further revealed that when the Deputy Commissioner of Police (New Delhi), Madhur Verma was asked about what caused a month delay in arresting the accused, he said,

On the basis of the complaint of the journalist, we booked the offender, we investigated, and recorded statements of the witnesses and got a statement recorded under Section 164 (of the Code of Criminal Procedure) also and thereafter arrested the accused.

The Deputy Commissioner further said, “In these kinds of cases, till the time we do not verify from the witnesses… and the statement to the Magistrate is also required. And despite issuing notices, the accused was not joining so it took some time to arrest.”
