Law Minister Proposes a National-Level Test for Lower Judiciary

While the Supreme Court’s attempt at introducing a centralized mechanism for appointment in the lower judiciary remains deferred for almost a year, Law Minister Ravi Shankar Prasad on Monday pitched for a national-level entrance exam for subordinate judiciary.

However, Prasad made it clear that he was not proposing on conducting a national level judicial service similar to the services such as the Indian Administrative Service and Indian Police Service.

He further said that the examination is aimed at getting the best talent into the subordinate judiciary. Prasad even said that the judicial officers can also appear for the exam.

Prasad proposed his idea while speaking at the launch event of the Nyaya Vikas website and an app – that are developed to monitor the progress in the development of judicial infrastructure in real time.

In the present scenario, judges of the subordinate judiciary are appointed either by the respective high courts or with the help of state-level exams conducted by the state public service commissions.

Although, the government in the past had favoured the idea of conducting an all-India judicial service by the Union Public Service Commission, the proposal was opposed by nine high courts. And while eight high courts have asked for changes in the proposed framework, only two supported the idea.
