Kerala Media vs. Lawyers: SC Declines Journalist Union’s Plea; Directs Them to Approach Kerala HC

The SC today disposed of a plea filed by the Kerala Union of Working Journalists (KUWJ) seeking directions to open the media room at the Kerala High Court, which was closed following the scuffle between lawyers and media persons during 2016.  

The top court’s bench comprising Justices UU Lalit and AM Sapre passed the brief order after taking a note of the submissions made by advocate Haris Beeran, who had appeared for the intervenor Kerala High Court Advocates Association (KHCAA).

In his submission, advocate Beeran stated that similar petitions with identical reliefs were pending in the Kerala HC.

The SC Bench agreed with this view and disposed of the petition, saying that no purpose will be served by keeping the petition pending in the Supreme Court and observed that the KUWJ has to put forward its grievances before the Kerala HC.

Case background:

In July 2016, a clash between the lawyers and media persons led to the shut down of the media room at the High Court. However, there are two versions telling a different story, resulting in the clash.

According to one version, an outrage triggered at the Bar following the news of the arrest of government pleader Dhanesh Mathew Manjooran for allegedly attempting to molest a woman. The situation got out of hand when the lawyers took the matter into their own hands and reportedly attacked some media persons within the HC premises.

But according to the other version, the lawyers claimed that the scuffle began between both the parties when a media person together with some goondas marched to the HC in protest. This resulted in stone pelting, in which an advocate was injured. The following day, the media room was expected to be closed as per the orders passed by the Registrar General.

But when lawyers spotted a few scribes in the room, they were told to leave the room and they obliged, which was later captured on the cameras by media persons. A few were the same scribes who were involved in the brawl, the previous evening. This annoyed the lawyers, leading to clashes in which a few media persons were at the receiving end.
