Justice S Muralidhar’s controversial transfer to Punjab and Haryana HC by the Centre

New Delhi: The Centre on Wednesday, 26th February 2020 notified the transfer of Justice S Muralidhar from Delhi high court to Punjab and Haryana high court.

A government notification of the move was released stating that, after consultation with Chief Justice Sharad Arvind Bobde, on Wednesday, President Ram Nath Kovind sanctioned the transfer of Justice S Muralidhar, Judge of Delhi High Court, to the Punjab and Haryana High Court.

Justice Muralidhar's transfer has stirred controversy within legal circles. There has been speculation that the move is punitive in nature, with the Delhi High Court Bar Association calling on its members to abstain for a day from work, while noting that these transfers appear to erode the common litigant's faith in the justice dispensation system and further hinder the fair and equal delivery of justice.

The controversy arose because Justice Muralidhar expressed dissatisfaction with the delay in filing of FIR’s against three members of the BJP. Anurag Thakur, Parvesh Verma and Kapil Mishra were those three leaders. On 25th and 26th February at 12:30 pm, at his house, Justice Muralidhar had heard the case related to Delhi violence.

However, the government claims that the transfer of Justice Muralidhar was recommended by the Collegium of the Supreme Court on February 12, which is also true, but the government released its notification on the evening of February 26. It is not the first controversy involving judge transfer. Also before this, there have been controversies surrounding the transfer of judges in the Modi Government.
