JNU Case: Court Directs Delhi Govt. to Decide Issue of Sanction within One Month


In view of the time being taken by the Delhi Government for granting sanction in the sedition case going on against the former JNUSU President Kanhaiya Kumar and other students, a Delhi Court has directed the Delhi Government to decide the issue within a period of one month.


The Court of Chief Metropolitan Magistrate Manish Khurana of the New Delhi District (Patiala House Courts) further mentioned that the delay on the part of Government to decide such issue is amounting to wastage of judicial time.


The Delhi Police had filed the charge-sheet in the instant case on January 14 but the Court could not proceed any further with the case in absence of necessary required sanction to prosecute Kanhaiya Kumar & Others in the sedition case.


The Court was informed by the Delhi Police that sanction for prosecution could not be obtained as the file was still pending with the Home Department of Delhi Government.


The matter was getting listed for hearing but then getting adjourned repeatedly on this ground since the filing of charge-sheet in January, the Court being disappointed with the on-going delay, stated that:


"The time which is being taken to finalize the issue of sanction or otherwise has caused wasted of judicial time as the case had been listed & adjourned repeatedly since the filing of the charge sheet”.


The Learned CMM further observed that:

"It is expected of the Delhi government that the decision regarding the sanction or otherwise would be taken within one month so that further processing in the present case may be done".

The matter relates to the year 2016 when during a protest, certain students including Kanhaiya Kumar, Umar Khalid, and others were allegedly seen raising anti-national slogans at the JNU Campus.

The matter now has been fixed for October 25 for further proceedings.
