FORMER CJI RANJAN GOGOI AS RAJYA SABHA MP

NEW DELHI: On Monday i.e. 16th March, 2020 the President of India nominated the former CJI to Rajya Sabha to fill the vacancy caused by the retirement of Senior Advocate K.T.S. Tulsi, one of the nominated Members.

Justice Gogoi who was appointed as the Chief Justice of India on 3rd October, 2018 retired on 17th November, 2019. The bench headed by him had delivered numerous judgments in cases such as Ayodhya, Rafale, etc. He had also piloted NRC's update in Assam.

Justice Gogoi has since been questioned from every angle as to whether his acceptance of the appointment infringes the constitutionally enshrined concept of separation of powers.

The Centre nominating a former CJI as a member of the Rajya Sabha pursuant to Article 80(3) of the Indian Constitution is unprecedented, four months after retirement.

In a decision that raises fresh concerns about the weakening nature of judicial independence, former Indian Chief Justice Ranjan Gogoi- arguably the most contentious CJI of recent times was nominated on Monday by the Central Government as a member of Rajya Sabha within four months of his retirement on November 17, last year.

Former Union Minister and Senior Advocate Arun Jaitely once bluntly stated “pre-retirement judgments are influenced by a desire for a post-retirement job”

A former Assam chief minister, Tarun Gogoi has said that there is no question he's a BJP favourite, otherwise he wouldn't be nominated.

Not only him but also appointed his brother. BJP has a soft corner for his family.” said Tarun Gogoi.

"I have accepted the offer of the nomination to the Rajya Sabha because of strong conviction, that the legislature and the Judiciary must at some point of time work together for Nation-building," Former CJI Ranjan Gogoi told the local Assamese news agency.

Justice Gogoi, speaking in his own defense, said "My presence in Parliament will be an opportunity to project the views of the Judiciary before the legislature and vice versa… Let God give me the strength to have an independent voice in the Parliament."
