Delhi HC seeks response from the Delhi Government regarding the delay in digitisation of District Courts

The High Court of Delhi through an order has sought response from the Delhi Government’s Finance Secretary regarding the proposals concerning digitisation of the District Courts, which are pending since 2018.

The said order has come viaa writ petition seeking directions to be issued towards recording the evidences through virtual hearings inthe District Courts.

The Delhi Government has, through its counsel Mr. Anupam Srivastava, contended that the two proposals by the District Courts to the Delhi Government as regards the procurement of electronic equipments whichare crucial in conducting virtual hearings have not been cleared yet as they would incura cost of more than Rs. 1 crore.

The president of Delhi HC Bar Association, Senior Advocate Mohit Mathur, has also submitted that both the litigants and the legal community are experiencing a great deal of difficulty in engaging in virtual matters before the District Courts.

Talking about the current procedure, judges in the absence of adequate bandwidth are resorting to use CISCO Webex software to conduct the virtual hearings. The said software provides a slot of 40 minutes at a single time and many counsels were of the view that they were getting disconnected automatically in between the hearings.

In light of the above submissions, the court has noted, “The need of the hour is to provide adequate bandwidth, Network attached storage and Routers, etc., to facilitate conducting virtual courts and it is also noted that all the proposals have been pending at the Delhi Government’s end since 2018.”

While concluding, the court has also directed that this order must be placed before the Law Minister of the Delhi Government.
