Delhi HC Awards Imprisonment in Tihar Jail for groundless accusations against Govt. Counsel[Read Judgment]

Delhi High Court rejected an application filed by Mr. Rakesh Kumar Gupta and sentenced him one week imprisonment for conducting groundless allegations of impropriety against Government counsel appearing for the Revenue Department. He was found guilty of contempt of Court and sent to Tihar Jail to serve the punishment.

The bench comprising Siddharth Mridul and Justice Najmi Waziri, found the respondent guilty of conducting baseless accusations against counsel who appeared and assisted the Court, also imposed a fine of Rs.2000 and lifted the imprisonment of 60 days, so that he may file an appeal against this order.

The Court observed that Mr. Rakesh Kumar Gupta sent an e-mail to counsel appearing on behalf of Revenue, levelling several allegations on the personal integrity of the counsel and dismissed Gupta’s various applications seeking a myriad of reliefs ranging from recording the court proceedings by phone to passing the interim award of Rs. 10 crores in his favour.

Senior Advocate Manoj Ohri, appearing for Gupta, withdrew from the case after the respondent refused to offer an unconditional apology. 

Thus, Gupta refused to step back and defended all allegations he made against the learned counsel who appeared on behalf of Revenue, also he expressed that the facts of the case were not comprehensively put before the court.

He further, demanded the Delhi High Court to present him for “Bharat Ratna” for this Huge public service at the risk of his own life for unveiling corruption in the Justice administration.

Gupta also accused the counsel of eluding most of the court hearing in the contempt proceeding.

Senior Advocate Vikas Pahwa, appointed as amicus curiae in the case, submitted that Gupta leveled baseless accusations against respected Government Lawyers who were appearing and assisting the Court.
