Delhi Govt. increases value of Welfare Stamp on Vakalatnama to Rs. 25 in Delhi


By virtue of a notification issued on Tuesday, by the Department of Law, Justice and Legislative Affairs of the Delhi Government, the value of welfare stamp that has to be affixed with the Vakalatnama by every advocate has been increased from Rs. 5 to Rs. 25 in Delhi.


The notification has been issued by the Delhi Government in the exercise of the powers conferred by Section 35 (Power of Central Government to make rules) read with provisos to sub-section (1) of section 27 (Vakalatnama to bear stamps) of the Advocates’ Welfare Fund Act, 2001. The AAP Govt. has made the following rules to amend the Delhi Advocates’ Welfare Rules, 2001, namely:


1. Short title and commencement – (1) These rules may be called the Delhi Advocates’ Welfare Fund (Amendment) Rules, 2019.

    (2) They shall come into force on the date of their publication in the Delhi Gazette.


2. Amendment of rule 21 - In the Delhi Advocates’ Welfare Fund Rules, 2001, -


(a) Rule 21 shall be re-numbered as rule 21 A and before that rule as so re-numbered, the following rule shall be inserted, namely -


21. Vakalatnama to bear stamps – Every advocate shall affix stamp of a value of twenty-five rupees on every Vakalatnama to be filed by him in the courts namely Supreme Court, High Court, District Court or a court subordinate to the District Court, tribunals and other authorities, wherever Vakalatnama is filed.”


(b) In rule 21 A as so re-numbered, for sub-rule(1), the following shall be substituted, namely:-


21A. Value and Design of Stamps.-


(1) Stamps shall be printed in the denominations of twenty-five rupees.”

The above mentioned notification also mentions that the same has been issued with the approval of Hon’ble Minister (Law), Government of NCT of Delhi. The notification will come into effect on the date of its publication in the official Delhi Gazette.


It is compulsory for every advocate to affix welfare stamp on Vakalatnama while filing it in any matter before any Court. If any lawyer deliberately fails to affix the same then he/she can be disentitled wholly or partly to avail benefits of the Advocates Welfare Fund.


The prevailing value of the Welfare Stamp that has to be affixed on Vakalatnama by every advocate in the national capital, before the issuance of the present notification is Rs. 5 for District Courts and Rs. 10 for Tribunals, High Courts and the Supreme Court.


The Delhi Government with assistance and support of the Bar Council of Delhi had recently announced for a sanction of funds amounting to Rs. 50 Crores from its budget which will be utilized for the welfare and social security schemes for the Advocates practicing in Delhi.
