Center bears the expenses of special Judge on Hadiya case

SC’s decision of appointing Raveendran to investigate Hadiya case, raises questions about the integrity of the Judicial system.

The Supreme Court today said its retd. Judge Justice Raveendran, under whose supervision the NIA would probe the controversial Hadiya case of marriage annulment, will receive 1 lakh as a consolidated fee from the center and 2 lakh per day for travelling outside Bangalore, apart from payments of all traveling, boarding, lodging and secretarial expenses, while discharging the responsibility entrusted to him.  

The issue came into existence after a petition filed by Shefan Jahan challenging Kerala’s High Court order of annulling his marriage with a Hindu girl who forcibly converted into Muslim religion for the purpose of marriage. The Court suspected the matter not just an isolated case but a pattern was emerging in Kerala, therefore directing NIA to investigate the matter closely and find the truth. The agency claimed that the case is a huge conspiracy of some emerging anti-social organizations, terming the case as an instance of “Love Jihad”.   

Senior Advocate Kapil Sibal and associate Indira Jaising, counsel for Shefan argued before the bench comprising CJI Khekar, expressed suspicions about the integrity of the trial and Shefan requested a Judge from outside Kerala, therefore the SC suggested its retd. Judge Raveendran to investigate the matter along with cooperation of NIA. The bench mooted two other Judges who were initially concerned by the bench like former Judge K.S. Radhakrishnan on the grounds that he knew Malayalam and the case documents are in Malayam and another former Judge K.T. Thomas. Anyway, the decision of appointing a Judge outside Kerala is a huge insult to the Indian Judicial System and the prestige of the court. It is like a Cricket Match wherein the referee is always appointed outside both teams in order to conduct a fair match, transforming the noble professional of Justice into sports.  

The Amount of consolidated fee will be paid within two weeks of Judgement, the bench directed the Center.
