CBI court extends Karti Chidambram's custody till March 9

New Delhi : On Tuesday March 6, the Special CBI judge Sunil Rana, extended stay of Karti Chidambaram for three more days in  CBI custody over  relation to its investigation into his alleged role in the INX Media case. The judge said in his order, this is necessary “to ensure continuity and to speed up the investigation to secure the evidence and to arrive at the truth”.

Karti,was arrested on 28 February by the CBI and then it was given only one day custody.This was extended by another 5 days and the same has been further extended for three more days.Under the law, at this stage the CBI can have custody of the accused for a maximum of 15 days only.

Over the weekend, Kirti was taken to Mumbai by CBI  where he was brought face to face with Indrani Mukherjea, former promoter of INX Media, who has said in a statement that she had paid him $700,000 to influence his father to facilitate FDI related approvals for INX. Incidentally Indrani is also in judicial custody in connection with the murder of her daughter Sheena Bora, in which she is a prime suspect.

The CBI which was represented by additional Solicitor General Tushar Mehta ,asked the court for detention for  nine more days as there is fresh new evidence  which requires his further interrogation. These new pieces of information were handed over to the judge in a sealed cover, as the CBI felt that mentioning them in open court could prejudice the investigation.

The CBI further alleged that if Karti were not in their custody, there is a risk that he could tamper with witnesses or evidence crucial to the case.The agency further alleged he has been non cooperative and has not provided them with passwords of his phone.

Senior Counsel,Dr Abhishek Manu Singhvi, who represented Karti Chidambaram, contested the CBI counsel argument and said CBI has no valid reason to hold him in custody and each time they create a new reason to ask for his further detention.He termed the case as political vendetta.He referred several cases in his defense where he said custody was provided only when there were cogent reasons and CBI has not provided any material which requires his further detention.He said Karti was willing to comply with any conditions the court felt necessary for his release, including going to the CBI headquarters for questioning every day at a fixed time.

 Singhvi further argued that his client had been cooperating with the CBI, but that he had the right to remain silent under the Constitution, and just because he wasn’t giving the CBI the answers they wanted didn’t mean he was being uncooperative. He went on to say he has visited CBI whenever summoned and charge of his client tampering with evidence runs contrary to facts as CBI has not provided so far any evidence to support this charge.
