BOMBAY HIGH COURT TO STATE: ESTABLISH FAMILY COURT IN EVERY DISTRICT

New Delhi: The Bombay High Court has ordered that the State Government take the initiative to establish Family Courts in each district.

According to the Family Courts Act, every city with a population of over a million should have at least one family court, as per a division bench comprising Justice Anil K Menon and Justice Makarand S Karnik.

The petitioner, a law student, said he was surprised to learn from RTI responses that more than 5,000 divorce cases were pending in Mumbai alone and only seven family court judges, even though, according to the 2011 census, six more judges were required, and the necessity could be even higher now due to population growth.

As per the petition, even though Maharashtra has a population of at least 11.24 crore people, according to the 2011 census, the state has only 19 family courts, when the law requires 39. According to the state's lawyer, the Registrar General of the High Court should be made a party to the plea because the family courts will be formed in consultation with the High Court administration.

The bench inquired as to where land was available for the establishment of family courts and suggested that the state first provide it. "You've taken the first step" (state). Please give us land. The first step is taken by you (state). Give us land. We’ll tell you how to build it (family court),” the bench said orally.
