Bhima Koregaon Case: SC extends House Arrest of Activists, pulls up Maharashtra Police

The Supreme Court bench headed by CJI Dipak Misra today extended the house arrest of five activists held in Bhima Koregaon case till September 12.

During the hearing, the SC bench pulled up Maharashtra Police for the press briefing regarding the arrest of five activists, saying they (police) tried to insinuate the court.

Justice Chandrachud, who was also part of the SC bench in the matter, told ASG Tushar Mehta to inform the Maharashtra Police officials that they should get involved in such things.

The SC bench further told the ASG, “You must ask your police officials to be more responsible. The matter is before us now and we don’t want police to be telling us that we are wrong.”

Following this, the bench adjourned the matter for hearing on September 12 after ASG apologised to the court on behalf of the state of Maharashtra. Also, it extended the house arrest of the accused persons till September 12.

Story so far:

The Pune police had arrested the activists last week for their alleged links with the banned Maoist groups and role in the violence at Bhima Koregaon village on January 1.

Following the arrests a day later, the Supreme Court ordered the state police to keep the arrested activists and lawyers under house arrest until September 6, instead of taking them to jail.

After this development, the Maharashtra police has filed a counter affidavit in the top court on Wednesday seeking custody of the five right activists for interrogation.

In the affidavit, the state police has claimed that keeping the accused under house arrest merely restricts their physical movement.

And so, there is still scope for the accused to not only destroy the evidence elsewhere, but also alert other potential accused even when sitting at home.

In the affidavit, the state police has also alleged that the activists weren’t arrested because of their dissenting views against the government, but because there was sufficient evidence to prove that the accused are allegedly active members of the banned CPI (Maoist) organisation.

In fact, the Maharashtra police further claimed that the material found from computers, laptops, pen drives and memory cards of the accused activists clearly show them as active members of CPI (Maoist).

The police, has thus, requested the Apex Court to go through the evidence submitted in a sealed cover. They even said that the evidence would make it amply clear that the accused persons are found to be committing and were planning and preparing for a series of criminal offences in connivance and conspiracy with other persons.
