BCI to lawyers: Gherao Parliament and burn law panel report

Burn Law Commission of India report. Fill jails and lay siege to Law Commission of India office. Lawyers across the country have been called upon by none other than their disciplinary body, the Bar Council of India (BCI), to do all those mentioned above to express their disdain for the law commission's 266th report recommending sweeping reforms in Bar councils as well as 'professional misconduct' by lawyers.

While not a single member of the legal fraternity is willing to accept the report, the BCI's decisions to gherao the Parliament and burn the commission's report are being mocked by lawyers in Tamil Nadu, who not long ago were suspended in droves for doing the exactly the same thing.

"We burnt copies of the code of conduct for lawyers which also empowered courts suspend lawyers for various acts of perceived misconduct. We also laid siege to the Bar Council of Tamil Nadu and Puducherry and the Madras high court. As a result, more than 125 lawyers were suspended from practice in courts and tribunals, and many suspension orders were issued directly by the BCI from Delhi," said K Muthuramalingam, who has been serving his suspension since November 2015.

The April 10 resolution of the Bar Council of India lays down 'agitation programmes' and starts off saying on April 16 all Bar associations must initiate a signature campaign against the law commission report. On April 21, lawyers must assembly during lunch break and burn copies of the report, it says.

"During luncheon interval, lawyers throughout the country will assembly outside their court premises and burn copies of the recommendations and bill of law commission. Thereafter, they will hand over a memorandum to the district collector or governor demanding rejection of the law commission recommendations and to throw it in dustbin. Lawyers will abstain from courts thereafter," it said.

On May 2, there will be a rally of former and present Bar council members "in full court dress," from Patiala House to Rajghat in Delhi. If the demands are not accepted even after that rally, there will be "massive rallies and jail bharo (fill jail) campaigns undertaken by the BCI and state Bar councils and associations." It then says there will be "gheraoing of office of the Law Commission of India, the Parliament, etc."

When asked about the propriety of a statutory body such as the BCI to call for gheraoing of the Parliament and burning of report by another statutory body, D Selvam, former chairman of Bar Council of Tamil Nadu and Puducherry, said, "We are opposing the report in toto. I will lead a delegation of Bar leaders and lawyers to the governor to present a memorandum demanding immediate recall of the contentious recommendations of the Law Commission of India." 

"How could the BCI, which punished scores of lawyers for burning copies, abstaining from courts and laying siege to Bar council office just last year, call upon entire legal fraternity across the nation to do the same thing, that too without even revoking the suspension of lawyers who took up similar public causes earlier," asked Muthuramalingam.
