Bar Council of India takes note of regular and continuous misconduct of some Advocates, calls for press meet tomorrow

Bar Council of India, Chairman Manan Kumar Mishra has released a statement announcing the regulatory body’s intent to take action against serious misconduct by certain advocates practicing in Delhi.

As per the statement released on Tuesday, these advocates would include those acting to create deliberate nuisance and making objectionable statements, thereby damaging and maligning the institution for their vested interests.

The statement is unclear as to which Advocates would be subject to the action indicated, or what the punitive action would be.

The BCI has accused a handful of Advocates as being in the habit of committing nuisance, thereby trying to lay undue pressure upon the Courts in order to get favourable orders. The statement further notes that the entire institution is becoming a mockery as a result.

They are trying to intervene in every such case where they find some scope to go to the media and get cheap publicity. In most of the cases they have been appearing without any locus. They set up some people…and … manage some Vakalatnamas just in order to intervene in the matters and create ugly scenes in the Courts.

Stating that several complaints have been received over the same, the BCI has remarked that it is high time that the Council take notice of the regular and continuous misconduct of these Advocates, because they are maligning the image of the entire Indian Bar.

Accordingly, the BCI has intimated that it will announce its decision against the said Advocates on January 25, 2018. A press meet will also be convened on the afternoon of January 25, at the BCI premises.

The full statement of the BCI reads as follows:

Indian Bar or their bodies are not supposed to be a silent spectator on sensitive issues and on the serious misconduct of Advocates.

For the last few months we have been receiving several calls, letters and complaints about the serious misconduct, objectionable comments and deliberate nuisances created by a few Sr. Advocates/ Advocates of Delhi. Several complaints have been received in the office of Bar Council of India. The Council is very well alive to the situation and is closely observing everything. Of course only a strong Bar can ensure an independent Judiciary, but it does not mean that we (the members of the Bar) are free to do anything and create ugly scenes in the Courts every day.

It seems that a handful of Advocates are bent upon damaging and maligning the Institution at any cost for their vested interests. These Advocates are in habit of committing nuisance and thereby trying to lay undue pressure upon the Courts in order to get favourable orders. Though in 99.9 % of cases they fail in achieving this goal but Bar now appears to be fed up with such activities and conduct. The entire Institution is becoming a mockery at the hands of only 3-4 such Advocates. They are trying to intervene in every such case where they find some scope to go to the media and get cheap publicity. In most of the cases they have been appearing without any locus. They set up some people…and … manage some Vakalatnamas just in order to intervene in the matters and create ugly scenes in the Courts.

It is high time when the Bar Councils will have to take notice of these regular and continuous misconduct of these Advocates because they are maligning the image of entire Indian Bar. Their posts, their statements and their irresponsible comments are watched by entire world and this is casting a very bad impression about our Bar.

We have received several complaints from people as well Bar Associations also to view the matter seriously. It is now becoming difficult for the Courts to discharge their functions properly. 95% of the senior members of the Bar are more than sensible. It is only 5% of  Lawyers who create a scene, day in and day out now a days and bring the bar and judiciary into disrepute. The entire legal fraternity of lawyers throughout the country are opposed to such nasty instances occurring in court premises.

The Council has taken the matter very seriously. and it will announce its decisions (as what is to be done on this front) on 25th January 2018.

The Council will also convene a press meet on 25th Jan.at 1.30pm.in the premises of Bar Council of India on this issue.

I request the Hon’ble members of the Bar to save the Institution and send their opinion and suggestions to the Secretary B.C.I. 

The Younger generation of the Bar is supposed to be more sensible on the issue because they are still to start or consolidate their innings. and if the pitch itself is spoilt by a few bad players …it will not be possible for them to perform well. Therefore, their role is very important and Bar Council of India would seek their support in improving the standard of Bar.
