All kinds of allegations are levelled against Judges before elevation: Chief Justice of India

Chief Justice of India stated that in the recent days there has been a trend that there have been allegations against judges whenever they are been promoted to a senior level or a higher court.

This particular statement was made by CJI when a bench consisting of three judges was hearing a case where the promotion of a judge was rejected when a female colleague had made allegations for sexual harassment against him. The woman, who had filed the case, was not ready to show any evidence to prove her allegations to the Gender Sensitisation Committee.

A Civil Judge of Madhya Pradesh filed a case of sexual harassment against a District Judge when he was just about to get a promotion to the High Court. No evidence other that WhatsApp chat messages were shown to the Gender Sensitisation Committee which was followed by reconciliation between both the parties. After studying the evidences of the text messages that were produced to the Court, Madhya Pradesh High Court had ordered to start disciplinary proceedings against the accused as his actions and conduct was unacceptable.

On behalf of the District Judge, Senior Advocate R Balasubramanium, stated that the court cannot rely upon evidences and start court proceedings when the two parties have reconciled. The Bench, then stated that both the parties (the Civil Judge and the District Judge) are adults and they have the right to act upon their own life decisions without the interference of the Court. The Court did not accept the WhatsApp chat messages as evidences but mentioned that the High Court has the inherent right to take disciplinary actions and initiate proceedings against an employee.

The Supreme Court of India directed the District Judge, who retired last year, to go as per the disciplinary proceedings and question the evidences against him. The Advocate, on behalf of the petitioner took time of one week for his client’s response.
