92 names recommended for HC judgeship pending with govt, says Law Ministry

Minister of state for law PP Chaudhary has informed the Parliament that 92 recommendations, made by various High Court Collegiums for appointment as judges, is pending with the government.

Chaudhary said that the 92 pending recommendations with the Centre include names reiterated by the SC Collegium as well.

While it is mandatory for the government to accept all the recommendations made by the Supreme Court Collegium for appointment of judges to HCs and SC, but in case of difference of opinion, the Centre sends back such cases to the SC Collegium for reconsideration. And, if SC again reiterates the names, it becomes binding on the government to make appointments.

However, in recent times, the government had sent recommendations twice for SC Collegium’s reconsideration in some cases.

As regards appointment of Judges of High Courts, 92 names recommended by HC Collegiums, including names reiterated and recommended by SC Collegium, are under various stages of processing with the government as per the procedure prescribed in MoP (memorandum of procedure),” Chaudhary said.

He also added that besides the 92 recommendations, 5 names recommended by the SC Collegium have been submitted to the top court for reconsideration.
