'Judicial Officers Not Having Experience At Bar Mostly Found To Be Incapable': BCI To Move SC For Mandatory Practical Experience For Judicial Service.

An application will be filed in the Supreme Court by the Bar Council of India for the modification of a previous order of Supreme Court which used to allow fresh law graduates to sit for judicial service examinations. The BCI in a press release had contended that, judicial officers do not have a proper practical knowledge and as a result most of them are found incapable in handling matters.

The BCI had argued that certain judicial officers lack proper and decent knowledge of the aspirations and desires of advocates and litigants. Many of these officers are found to be impolite and impractical in their conduct with the members of the bar and litigants.

The BCI had also contended that, non-experienced judicial officers are not capable enough to handle matters efficiently and also one of the main reason for delays in disposal of cases. An application will soon be filed by BCI for modification of an order which was passed by the Supreme Court in a case, [1]All India Judges Association V. Union of India in which requirement of 3 years of experience in bar to become eligible to sit for judicial service examination was removed.

The BCI had also claimed that it would also file an application of impleadment regarding a recent petition filed in the Supreme Court in which the petitioner had challenged the notification given by the High Court of Andhra Pradesh, which defined 3 years of minimum practice as a prerequisite for applying for the position of civil judge of the junior division. According to the petitioner, the notification of Andhra Pradesh High Court is illegal and unwarranted.
