'Judge presides over a case to see not only that no innocent man is punished but no guilty escapes', Court sentences man to life term for Murder

On 10th February, 2019, the accused Lalit Kumar shot an 18 year old student Raminder Singh and called up Manik Garg, a welfare society volunteer and got the victim admitted to the hospital. Contact number of the victim was not shared by Manik Garg in his testimony just to save the accused from being proven guilty and above that he shared another wrong number to save the accused and mislead the court. The investigating officer also was in favour of the accused.

Bathinda District and Sessions Judge, Justice Kamaljit Lamba stated that the investigating officers had made false evidences to protect the accused. Inspector Davinder Singh produced false eyewitnesses to the court in favour of the guilty.

According to Justice Lamba, a judge has two responsibilities, which include, an innocent man should not get punished and a guilty should not get the chance to escape from his criminal act.

According to the powers of the court, call details and tower location of the mobile servers were asked to produce under Cr.P.C., just to find that the investigating officer had collected these evidences but had not produced those to the Court.

After investigating the aforementioned details, the judge stated that relying upon the call and location details, the deceased and accused were at the same location at the time of the crime and it can be assumed that there were certain incidents that took place between them that ended up with murder by the licensed and registered weapon which the accused possessed. Justice Lamba said that there were blood traces of the victim on a jacket of the accused and the recovery of the mobile phone of the victim made the case even stronger against the accused. Manik Garg was given a chance by the court to explain himself to why the court cannot make charges against him for his illegal acts.
